Terms and Conditions of Use

Welcome to Siddhii Landmark. These Terms and Conditions ("Terms", "Agreement") govern your use of our website, services, and property transactions. By accessing or using our services, you agree to be bound by these Terms.

  • "You," "User," "Client," "Buyer" refers to any individual or entity accessing our website or engaging with our services.
  • "Property" refers to any real estate unit (residential, commercial, or otherwise) developed, marketed, or sold by Siddhii Landmark.
  • "Services" refers to all services provided by Siddhii Landmark, including property development, sales, marketing, and related services.
  • "Website" refers to www.siddhiilandmark.com and all related web pages and mobile applications.
  • "Agreement" refers to the sale agreement, booking agreement, or any contract entered into between You and Us.
  • "RERA" refers to the Real Estate (Regulation and Development) Act, 2016 and MahaRERA (Maharashtra Real Estate Regulatory Authority).

2. Acceptance of Terms

By accessing, browsing, or using our website and services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Siddhii Landmark.

If you are entering into this Agreement on behalf of a company or legal entity, you represent that you have the authority to bind such entity to these Terms.

3. Website Use and Restrictions

3.1 Permitted Use

You may use our website for:

  • Making property inquiries
  • Scheduling site visits
  • Accessing company information
  • Downloading brochures and materials for personal use

3.2 Prohibited Activities

You agree NOT to:

4. Property Booking and Purchase Terms

4.1 Expression of Interest

Property inquiries and site visit requests do not constitute a binding agreement. An official booking requires submission of a booking form, required documents, and booking amount.

4.2 Booking Process

  1. Site Visit: Schedule and complete a property site visit
  2. Unit Selection: Choose your preferred unit/apartment
  3. Document Submission: Submit required KYC documents (PAN Card, Aadhaar, Address Proof)
  4. Booking Amount: Pay the booking amount (typically 5-10% of total property value)
  5. Booking Form: Complete and sign the official booking form
  6. Agreement Signing: Sign the Sale Agreement within the specified timeline

4.3 Pricing and Payments

  • All prices are subject to change without prior notice until booking confirmation
  • Prices include base price and may be subject to additional charges (parking, club membership, etc.)
  • Applicable taxes (GST, stamp duty, registration charges) are additional
  • Payment schedules are as per the agreed payment plan in the Sale Agreement
  • Late payment charges may apply as per the Agreement
  • All payments must be made through legal banking channels

4.4 Documentation Required

  • PAN Card (mandatory for all buyers)
  • Aadhaar Card / Passport / Voter ID
  • Address Proof (Utility Bill, Bank Statement)
  • Passport size photographs
  • Income Proof (if loan is required)
  • Bank Account Details

5. Cancellation, Withdrawal, and Refund Policy

5.1 Buyer's Cancellation Rights

As per RERA regulations, buyers have the right to cancel their booking under the following conditions:

  • Cooling-off Period: 14 days from the date of booking (booking amount refunded with minimal deduction)
  • Pre-Agreement Cancellation: Before signing the Sale Agreement (booking amount refunded with deductions as per policy)
  • Post-Agreement Cancellation: Subject to terms in the Sale Agreement and RERA guidelines

5.2 Refund Process

  • Refund requests must be submitted in writing
  • Refunds will be processed within 60-90 days of approval
  • Deductions may include administrative charges, legal fees, and opportunity costs
  • Refunds will be made to the original payment source
  • Interest on refund amount as per RERA guidelines will be provided if applicable

5.3 Company's Cancellation Rights

Siddhii Landmark reserves the right to cancel any booking in cases of non-payment, submission of false documents, violation of terms, or for any other legitimate reason as per RERA regulations.

6. Possession and Handover

6.1 Possession Timeline

  • Expected possession date will be mentioned in the Sale Agreement
  • Possession is subject to completion of construction and receipt of occupancy certificate
  • Grace period as per RERA regulations may apply
  • Buyer will be notified 30-60 days before possession

6.2 Possession Conditions

  • Complete payment of all dues
  • Completion of registration formalities
  • Payment of stamp duty and registration charges
  • Signing of possession letter
  • Payment of any pending dues or charges

6.3 Delay in Possession

In case of delay in possession beyond the grace period, compensation will be provided as per RERA guidelines and the Sale Agreement terms.

7. Property Modifications and Specifications

7.1 Specifications

Property specifications, amenities, and features are as mentioned in the approved plans and brochures. Siddhii Landmark reserves the right to make minor modifications in specifications, layout, or amenities due to technical, legal, or regulatory requirements without prior notice.

7.2 Buyer's Alterations

Buyers are not permitted to make any structural alterations during construction. Post-possession alterations must comply with local building regulations and society rules.

7.3 Common Areas

Common areas and amenities remain the property of all unit owners collectively and are managed by the society/association as per bye-laws.

8. RERA Compliance and Regulations

Siddhii Landmark operates in full compliance with the Real Estate (Regulation and Development) Act, 2016 and MahaRERA regulations.

8.1 RERA Registration

  • All our projects are registered with MahaRERA
  • RERA registration numbers are displayed on our website and marketing materials
  • Buyers can verify project details on the official MahaRERA portal

8.2 Buyer's Rights under RERA

  • Right to complete and accurate information
  • Right to quarterly construction updates
  • Right to timely possession or compensation
  • Right to grievance redressal
  • Right to refund with interest in case of project delay

9. Intellectual Property Rights

All content on our website, including but not limited to text, graphics, logos, images, designs, photographs, videos, and software, is the property of Siddhii Landmark or its licensors and is protected by intellectual property laws.

9.1 Restrictions

10. Disclaimer of Warranties

11. Limitation of Liability

To the maximum extent permitted by law, Siddhii Landmark shall not be liable for:

  • Unauthorized access to your information
  • Third-party content or links

Our total liability shall not exceed the booking amount paid by you.

12. Force Majeure

Siddhii Landmark shall not be liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government orders, strikes, riots, war, terrorism, civil unrest, labor disputes, or material shortages.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Pune, Maharashtra, India.

Before initiating legal proceedings, parties agree to attempt amicable resolution through negotiation and mediation.

14. Dispute Resolution

14.1 Grievance Redressal

For any complaints or disputes, buyers should first contact our Customer Relations team. We are committed to resolving issues promptly and fairly.

14.2 RERA Tribunal

If the dispute is not resolved satisfactorily, buyers have the right to approach the MahaRERA tribunal or consumer courts as per RERA regulations.

15. Amendments to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
